When you file a Chapter 13 Petition, you do not automatically accomplish an acceptance or rejection of any unexpired lease or other executory contract. You must assume, assign or reject any executory contracts or unexpired leases as part of your Chapter 13 plan. The Trustee does not assume, assign or reject an executory contract or unexpired lease. It is your responsibility to do so. You must handle these matters timely and appropriately because there may be specific time limitations that apply.
