You are required to attend your scheduled Section 341 Meeting of Creditors. The hearing is conducted by the Trustee or Staff Attorney for the Chapter 13 Trustee. The purpose of this hearing is to allow the Trustee and any creditors who attend to question you about your case. The Trustee will also identify any problems with your plan that need to be corrected before your plan can be confirmed. You will be allowed to ask questions about the process at this hearing.

Bring a photo identification and your social security card or other proof of your social security number to your hearing. Your identification and social security number must be confirmed on the record before your case may proceed. Your failure to bring these items to the hearing may seriously impair your rights to continue your case.

Make sure that you have provided your attorney with copies of your state and federal tax returns for the two prior years before your hearing so that your attorney may provide copies to the Trustee before or at the hearing. In addition, you must make sure that you have made at least one or more plan payments (depending on whether you are making your payments weekly, bi-weekly, semi-monthly or monthly) before your hearing is scheduled. The Trustee must be able to advise the court at your confirmation hearing that your plan is being funded and that you have demonstrated the ability to make the plan payments that are proposed in your plan or in the Trustee’s recommendation for confirmation of the plan. Please bring with you to the hearing any proof of payment (receipts for money orders or cashier’s checks or paycheck stubs showing the plan payment deduction).
